BYE-LAWS MADE by MRS. GERTRUDE BARBARA RICH TENNANT (widow), the 'iwner, pn-prietor, and occupier of a certain navigable cut or canal, known as the TKXNANT CANAL," situate in the county of Gla- morgan In puisuance of the provisions of 'The Ex- plosives Act, 1875" (with the sanction of the Board of Tra'ie), for regulating the conveyance, loading and un- loading of Explosives upon the said Tennui- Canal. Section 3 of the Explosives Act, 1S75, defines the term Explosive as follows (1.) Gunpowder, nitro glycerine, dynamite, gun-cotton, blasting powders, fulminate of mercury or of other metals, coloured fire-, and every other substance, whether similar to those mentioned or not, used or manufactured with a view to produce a practical effect by explosion, or a pyrotechnic effect and also (2.) Fog signals, fireworks, fuse-, rockets, percussion caps, detonators, cartridges, ammunition ot all descrip- tions, and every ad Iptation or preparation of an Explo- sive as above defined. j I.-No person shill send o' convey, nor cause to be sent or conveyed. 011 to or upon the Tenn mt C>nal, or any wharf connected therewith, for dischar.e or conveyance ^"merchandise, any gunpowder or other explosive, with- out having previously given to the prine pal resident canal agent, or some wharfinger, lock-keeper, or toll collector of the Company, a 0 hours' written notice stating the nature, quantity, and destination of such xplosive. and the place where it is intended to be brought on to the said canal, or any such wharf as aforesaid, and having had an intimation from the said owner or other the owner or owners for the time being of said canal, or from her his or their principal resident agent, that the said owner or owners is or are prepared to receive the consignment. 2.—The master or person in charge of every bo .t. ship, or barge carrying any gunpowder or other explosive, shall, immediately upon sue 1 boat. ship or barge entering into the said canal, or taking any gunpowder or other ex- plosive on board, give to the agent, wharfinger, lock- keeper, or other person in charge (for the said owner or owners) of the nea,est"office or toll-collecting place on or adjacent to the s lid canal, a writt n notice, stating the nature, quantity and destination of such gunpowder or other explosive. 3.—No person shall send or convey, or cause to be sent or conveyed, on to or upon the said canal, or on to any wharf connected tly?re with. for conveyance a s merchandise. any gunpowder or r.ther explosive which is not securely packed in manner prcsoihed by the said Act. or by the rules relating to packing for the time being in force there- under as the c*se may be, and which has not legibly marked upon each outermost packet, by label or brand, in the case of percussion caps, or of fuzes for blasting, the words "percussion caps or fuz s for b asting," as the case may be. together with the name and address of the owner or sender and in the case of gunpowder or blasting powder the word "gunpowder'" or "blasting powderand in the case of any other explosive, the special nap"e of the particular explosive, and also the word "explosive, together also with the name of the owner or sender, and otherwise as directed by the Act and by any rules in de thereunder and which may be in force for the time being. 4.—No person shall send or convey, or cans- to be sent or conveyed, on to or upon the said c-mal, any gunpowder or other explosiv.% except in the hold of a ship, boit or barire, with a closed d«ck, closely-fitting hatches, securely fastened and covered with tarpaulin or raw hides, and double bulkheads at each end of the stowage space, 1 ned with some non-coaibustible material. No iron or steel shall be placed in the interior of the portion of such ship, boat or birge, where the explosive is deposited, unless the same be covered, either permanently or temporarily, with leather, wood, cloth, wadmili-tilts or other such- like and suitable material; nor shall any fire-place, stovo, or stove-pipe in such ship, boat, or barge be nearer to the stowage space than eighteen inches from the outside of the bulkhead, which shall be covered near such fire-place, stove, or stove-pipe with lead. All package containing gunpowder or other explosive shall he laid in the hold upon and covered with tarpaulin, raw hides, Wadmili-tilts or other such-like and suitable mateiial. In the stowing of explosive substance ia any ship, boat or barge due precaution shall be taken by means of a partition or other- wise, and by careful stowing to secure such explosive substance from bfdug brought into contact with or en- dangered by any other article or substance c nveyed in such ship, boat or barge which is liable to cause tire or explosion. 5.—Any explosive of the 5th (fulminate) class, or any such explosive of the 6th (ammunition) class, as contains its own means of ignition, or any explosive of the 7th (firework) class, shall not be conveyed in the same ship, boat, or barge with any explosive not of the class and division to which it belongs, unless it be sufficiently separated therefrom to prevent any fire or explo-ion which may take place in olic such explosiv • from being com- municated to another and any explosive exceeding 50 lbs. in weight shall not be conveyed in any ship, boat or barge which is carrying, as merchandise, any article liable to cause or communicate fire or explosion, such as char- coal, lucifer matches, aiticles for striking a light, or petroleum, as defined by the Petroleum Act, 1871, or any Act or Acts repealing or amending the same. 6.—The master or person in charge of any ship, boat, or barge, carrying any gunpowder or other explosive shall not permit such ship, boat, or barge, to remain in any lock, dock. or basin, or to be moored, except in a belth specially directed by a dock-master, wharfinger, lock keeper, toll-collector, or other authorized agent of the owner or owners for the time being of the said car,al; and shal' not in any case permit such ship, boat, or barge to remain or be moored within 200 yards, of any steam engine or furnace. 7.—The master or person in charge of any ship, boat, or barge, ca rrying any gunpowtler or other explosive, shall not permit the same to bp loaded or unloaded, in whole or in part, except between sunrise and sunset. 8.—No ship, boat, or barge shall at any one time carry, or have on board, any gunpowder or other explosive weighing in the aggregate upwards of 50,000 lbs. 9. —No ship, boat, or barge carrying any gunpowder or other explosive shall enter or remnnitiorupunthes.dd Canal without a red flag, or metal vane painted led, two feet square at the least, which shall be shewI, in a con- spicuous place above the deck and there shall also be kept burning in a conspicuous nlace on every such ship, boat or bartre, between sunset and sunrise, a hmp, shewing continuously, ahead and astern, a red light, capable of being distinctly seen, on a clear night, at a distance of 200 yards. 10.—Every ship, boat, or barge, containing any gun- powder or other explosive shall at all times have at least. one competent man on board, and in charge of such ship, boat, or barye, and her cargo. 11.—No ship, boat, or barge, carrying any gunpowder: or other explosive shall be towed or propelled otherwise tban by wind, animals, or men. XM shall any such ship. boat, or barge, except for the purpose of passing, ap- proach nearer than 200 yards to any other ship, boat, or barge, conveying or having on board any gunpowder or other explosive. 12.—Every ship, boat, or barge shall, so long as there is any gunpowder or other explosive on board, proceed with ail convenient speed, and without any avoidable delay, to her destination. 13.-No ship, boat, orbar<?e, containing any gunpowder or other explosive shall, whilst being loaded or unloaded, be detained for any longer time than would, with all due diligence, be necessary. 14.—While the loading, unloading, or conveyance of gunpowder or other explosive is gaing on, all persons engaged in such loading, unloading, or conveyance, shall observe all due precaution for the prevention of accidents by fire or explosion, and for preventing unauthorized persons having access to the gunpowder or explosive so being loaded, unloaded, or conveyed, and shall abstain from any act whatever which tends to cause fire or ex- plosion, and is not reasonably necessary for the purpose of the loading, unloading, or conveyance of "uch explosive or any other article carried therewith, and for preventing any other person from committing any such act, and any such other person who, after being warned, shall commit any such act, shall be deemed to have committed a breach of this regulation. In the case of a ship, boat, or barge, conveying gun- powder or other explosive to an amount exceeding 100°lbs. in weight, due provision shall be made for preventing the introduction into such ship, boat, or barge, of fire, lucifer matches, or any substance or article likely to cause ex- plosion or fire or the introduction of any iron, steel, or grit, so as to come into contact with such explosive and in any such ship, boat, or barge, in which the explosive conveyed is liable to be dangerously affected by water, due precaution shall be taken to prevent water from coming into contact with any Isuch explosive. This re- gulation shall not prevent the introduction of an artiScial light, of such construction, position, or character, or of safety matches of such character as not to cause any danger of fire or explosion and nothing in this Bye- Law shall apply to any explosive of the 1st Division of the 6th (ammunition) class, provided the Rules spec;fied in the order of Her Majesty's Secretary of State for the Home Department, No. 3, E. in reference to ammunition of that class, shall have been complied wiih in regard to ) such explosive, and provided all due precautions are taken tor the prevention of accidents. 15.—Any explosive which for the time being is neither authorized (by license or continuing certificate),_ to be manufactured for general sale, nor authorized by license to be imported for general sale, may be carried only in such manner as shall be specially directed by the owner or owners for the time being of the said canal provided that this bye-law shall not extend to any explosive whii-li, under sub-section 9 of section 40 of the said Act, or under any order in Council made in pursuance ot such section, may lawfully be imported without any license. 16.-These bye-laws and all the provisions ol the said Act shall be observed by all the agents and servants of the owner or owners for the time being of the said canal, and all persons using or engaged upon the canal, or any wharf, dock, lock, or premises connected therewith. 17.—Every person committing any breach of, or in any way infringing any or either of the above bye-laws sha be liable to the following penalties, that is to to a pecuniary penalty not exceeding £ 20 for each .ffence and not exceeding £ 10 for each day during which such offence continues—and also to forfeiture of all t gun- powder or other explosive in respect ot which, or which shall be found in the slup, hoat ur barge 10. 01 i respect of which any such bre.tch or infringement sh,Jl take place. All penalties may b-: recovered, enfoiced, and applied according totheprovisions of the said Act. 18. The owner or owners of any ship, boat or barge carrying gunpowder or other explosive, will be required to pay to the owner or owners for the time heii g of the said canal, a reasonable chaige for any special services rendered. 19.—These bye-laws are and shall be deemed to be supplemental to the Act of 3S Victoria, chapter 17, en- titled, "The r xplosives Act, lSi5." and in addition thereto, and in no maimer in contravention of the said Act. 20.—In these bye-laws the wo"ds "Gunpowder," Ex- plosive, "Master," "Owner," *'WharV "Ship, "Boat and Barge" shall have the same respective me ings as are assigned to them in and by "The Act 1875."
