The ooTtnty magistrates assembled in great foroe to hear the charge of wilful murder which had been brought against Dr. Stephen Ecclee. I It was not a common murder; the posi- tion of the parties and the romantic space I with which it was flavoured took it out of that category. I The police admitted from the outset that the evidence which they had was purely of a circumstantial character, but. still, it was sc cogent ae to warrant the arrest, and, as they submitted, a remand. Evidence was given of the finding of the corpse, and of how it was brought, to the Dynevor Arms; of the admission by Eccles that the knife with which the murder had been committed was his knife. Then Ben o'r Cae was called. He described j how he came upon the murdered man. ajid gave the same acoouiut of the affair that he had given before the coroner. He had recited it to himself so often that it sounded almost like the evidence of a police-constable in a Metropolitan police-court. There was one thins1 which struck the Bench with regaxd to the evidence of "Ben, and that was the care with which he reiterated and emphasised his opinion that the murder could l not possibly have 'been committed by the prisoner. To such an extent was this carried that it occurred to one of the justices to ask whether he could suggest anyone who sould have done it—did he suspect Miss Stepney, for instance? No. some old tramp from the quarries. per- haps. Very likely Dr. Eccles had lost the 1 knife at the operation in the morning. 'Wjfaat more probable? There were plenty of bad characters from over the hills—good-for- nothings. "Poachers, maybe?" asked the justice, look- ing hard at Ben. "Poachers, eh, very like," Ben answered, almost sadly. The rector went into the witness-box. He I wished to make a statement. He had before the coroner given the impression that Dr. Eccles was, in his opinion, the murderer. He had considered the matter einoe. His con- science told him tha.t he had been hasty in passing his judgment. He agreed with the I last witness. He had known the doctor for many years; it was quite impossible that he I should have done such a thing. He wished to apologise to the prisoner publicly for the wrong he had done him. I The rector humiliated himself with the air of a martyr. He thought he had only to say this for it to be accepted as a matter of course. In that he was mistaken. The solicitor for the prosecution wished to ask a few questions. Then they went into detail with regard to the oonnoction between the broker and the rector and "Winifred. The rector admitted that the broker was the rival of the prisoner, I and that he himself favoured his pretensions. I He had told Dr. Eooleø so. The doctor had certainly been very much upset, very excited, when he told him of the proposal of the deoeased. I Had he used any strong language—anything which would lead anyone to suppose tha.t he had oontemplated vengeance? The rector wished to be strictly accurate. I He desired to place Eccles in as good a. light as possible; still he would speak the exact truth, neither more nor less. He hesitated. I am sure. I do not recollect that he said anything about vengeance." "Still, you came to the conclusion that he was angry?" "Yes. he was angry and excited; any man would be under the circumstanoes." "That will be for the jury to say." Dr. Morgan was called with respect to the post-mortem examination. He was very grieved that he should be called upon to give evidence against-his brother practitioner. He bad known Dr. Eccles for many years, and he had always found him a man of honour. and very skilful and learned in his profession. "That is not what we have to consider," remarked the justice who had interrogated the rector. You made a post-mortem examination, we understand. Will you tell us what you found?" Then Dr. Morgan described the wound. and how the knife had penetrated the heart, and had. undoubtedly, caused instant death. Such a knife as this?" "Yes." I understand you to say that it required a very powerful blow?" "Yes; the ribs were partly cut and bruised." Could it have been a case of suicide?" "I cannot conceive it possible." Or an accident?" Strange things happen by accident. I am unable to say ^positively that it could not possibly have been an accident, but I am unable to suggest the sort of accident." "you are acquainted with Miss Stepney; could she-" She would be a very powerful woman if she could. One can imagine that even a I feeble woman, throwing herself violently upon feeble woman. throwing herself violently upon [ a man on the ground, might, with the assis- tance of the weight of her body. exercise great force; still, the chances are so very remote, and this blow was struck at the heart with precision." "We are to take it that you do not consider I that the murder could have been committed I by Miss Stepney?" "Quite so." I The prisoner was remanded for a week. The court adjourned. He had telegraphed to Swansea for a local Eolicitor of repute named Theobald. This gentleman had appeared when the first wit- ness was in the box, and he had hurriedly advised Eccles to say nothing, to ask no ques- tions; there would be plenty of opportunity when the line of defence was decided upon, and this could not be done in a hurry. Mr. and this could not be done in a hurry. Mr. Theobald made notes of the evidence, but, save for bowing respectfully to the bench, 1 took no part in the proceedings. He was too old and wily a bird to commit himself or his client on the first day of magisterial in quiry. ¡ ¡ I "Now," said the lawyer, adjusting his eye- glasses and taking a. pinch of snuff, "you have told me the whole story so far as you know it. Are you sure ycu have omitted nothing?" They were in the prison room alone. "Why do you ask me?" demanded Eccles, I almost roughly. "Because my professional instinct tells me that, although in the main you have told me the truth, still a moment's hesitation con- veyed to me that at one point you were hiding something." Eccles made no answer for a time; he had agreed with Ben to say nothing about the cave and about showing Bob the knife. "I did not wish to bring & certain matter into this, certainly," he answered; "brildes, it is immaterial." "Pardon me, that will be for me to judge. You left the quarry at about two o'clock; at any rate, that is an hour, which it will be eaey enough to prove; from thence you pro- ceeded towards Ystrad. Who did you visit at Ystrad?" "John Williams, and also Mra. Oowan of the Bell Inn, Caerphilly" "Which first?" "John Williams." "What time was it?" "Just getting dark." "It gets dark about a quarter to five. Ton were not from two o'clock to a quarter to five getting from the quarry to Ystrad?" The lawyer had trapped the doctor. He smiled grimly. "Now be frank; what did you do and. where did you go, and who did you see in that time?" "Whatever can it matter what I did then; the murder was committed after that." ''Might have been and might not. Oome, Dr. Eccles, you must tell me, or else I cannot undertake your case." Then Eccles told him about the meeting with Bob, and that the last time he had seen the knife was in the cave. "That is what you call quite unimportant! I really am not surprised that innocent people suffer when they behave in this way." The lawyer was indignant. "It is quite impossible, Mr. Theobald, that Miss Stepney could have committed this crime -and-I naturally did not wish suspicion to attach to her." "I suppose, my dear sir, that you are parti- cularly desirous of getting hanged for a mur- der you have not done. and that you have sent for me to assist in the operation?" "Miss Stepney is as innocent as I am," very firmly. "Very likely, but that is not the point just now; at what time did you leave her?" At about four." "It would take three-quarters of an hour to get to Ystrad. That brings you to John Williams's at, as I said, a quarter to five. How long did you remain there?" "-Not many minutes." to John "Only old Richards driving some cows." "Give me his name and addrem?" This was done, as also was a list of the persons he had seen at John Williams's. "Now when you left John Williams you went to Mrs. CoWên. What time did you get. there?" Five, or perhaps a. quarter past." "Did you stop there long?" "She gave me a cup of tea, and Co-wan came in and offered me his nag to get home, and I said I would walk. I must have been trbere three-quarters of an hour, not more." "That makes it that you were at Oaerphiljyp three miles away from where the body was found, at the time the murder was oommxtited. So far so good. Now did you go straight trcna Caerphilly homewards?" Tes, I came on the Tetrad-road, until I met Ben o'r Cae ronniug towards me." "Did you meet anyone on the road; try and recollect; one oannot have too many witnesms in such a ca.æ?" Yes, I met John Welsh's lads at the crow roade; they were going home." The solicitor took a note. "Well, now, it seems to me that with luck we shall prove a tolera.bly compete alibi. I must go and hunt up these witnesses; mean- time I trust, you will speak to no one." "You think my defence reasonably dear?" "Yes, unless you have concealed eometiirog else from me. See what you would have done had I accepted yoror statement. Yon would I have said that it took you from two o'clock to a quarter to five to get from the quarry to Ystrad. Juøt consider the complexion that would have put on your case. You, might have got acquitted at the Assizes, but you would certainly have been committed for trial." "And—anyone else-?" the lawyer oould not resist the tempta-tion to wink, a contortion ha was on oopaeion somewhat pa,rtiaJ to. The prison regulations forbade the solicitor from being a postman; still, this was an ex- ceptional case, and the conscience of a lawyer is proverbially elastic. Eccles wrote a pencil letter which, considering the tim» it took. Mr. Theobald thought unnecessarily long. He once interrupted to ask if he should call in the assistance of a shorthand clerk, but meet- ing with no response he busied himself with making notes of the persons he should have to see in the morning. This was a sensational case, and Mr. Theo- baJd determined to devote the whole of his personal time and energies to its elucidation. He would not even trust a clerk to see the witnesses; he would call upon them and take their statements himself, so that there should not be the slightest slip. Ultimately he left the prison gates with more love ami kisses in his bag than 'that, sombre article had ever carried before. (To be continued).
